Company provides evidence to panel that destroys any chance of it winning UDRP for Reckon.com.
Australian company Reckon Limited, which uses the web address reckon.com.au, has lost a UDRP for the domain name Reckon.com.
It’s pretty clear what happened in this case. Reckon Limited tried to track down the owner of Reckon.com to buy the domain name, but quite simply couldn’t get a response. So, as a last ditch effort, it filed a UDRP.
Of course, not being able to get a response from a domain owner is not grounds for a UDRP.
The domain owner didn’t respond to the case (probably because he didn’t know about it), but Reckon Limited helpfully provided evidence to the panel that suggested the domain name was registered in good faith. The domain was used for many years to promote a computer product by the brand name Reckon, and the Australian company provided printouts to the panel showing this.
The panel used that evidence to rule that the domain wasn’t registered and used in bad faith, thus denying the complaint.
