Panel not convinced that West Corporation should get Entrado.com domain name.
Well-known domain name investor Mrs Jello, LLC, commonly known as “Mrs Jello”, has successfully defended against a UDRP case brought by West Corporation.
West Corporation (which has a good domain name West.com) has a subsidiary called Intrado (which has a bad domain name Intrado.com that is easy to misspell and doesn’t even resolve without the www in front of it). It appears that some people might misspell it as the common Spanish word Entrado, which is the basis for West Corporation’s complaint against the domain name Entrado.com.
But a three person National Arbitration Forum panel wasn’t persuaded by West Corporation, finding that West did not make a prima facie case that Mrs Jello lacked rights or legitimate interests in the domain name. The panel also found that the domain name wasn’t registered in bad faith:
The Panel finds that a respondent is free to register a domain name consisting of common terms for use of those terms in their common descriptive sense as the Respondent did in the instant case. Therefore, the Respondent did not register or use the entrado.com domain name in bad faith…
The panel declined to find reverse domain name hijacking.
