Sedo changes TOS to reflect changes.
Sedo sent a notice to customers today about changes to its terms of service. Although I haven’t read the entire revised TOS, the company highlights three key changes:
1. Buyers have the ability to submit offers on fixed price listings below the “buy now” price. This could be good, but it’s all about the execution. If it’s clear to buyers that they can offer something less than the asking price then it could defeat the purpose of “buy now” listings.
2. Sedo parking now has zero click (transfer visitors directly to an advertiser without a clicks). Customers are automatically opted in.
3. Changes to the standard sales contract.
The new terms of service go into effect March 16.

I wanted to take a moment to comment on the new feature for Buy Now listings (as I did on TheDomains.com), to help allay anyone’s concerns about upcoming product changes:
1. Sellers will be able to opt-in/opt-out whenever they want – this will not be a required part of listing as Buy Now, but can help create a lead list for sellers, even for Buy Now domains. This could also help sellers with their pricing strategies and to learn more about the general interest in their domains. Even better: sellers get their domains promoted on SedoMLS partner sites that require Buy Now prices AND can also entertain offers from interested buyers.
2. This feature is not yet available, but we wanted to make sure that the T&Cs anticipate future product launches. Also, when launched, this new feature for Buy Now listings will be available as a beta to a select group of sellers.
4. We haven’t launched the feature yet but are looking for feedback from all sellers. You can take a quick survey at http://sedo.com/us/sedo/survey/, which will help us improve Buy Now listings for everyone. We take member feedback very seriously, and it’s the driving force behind all updates and improvements at Sedo, including this one.

The auction houses love buy it now because it brings them so much more in commissions, don’t fall for it, you lose so much power in the negotiation.

If buyers can offer prices lower than the BIN then you’ll miss a lot of the big sales to lowers selling price and be more tied up with tire kickers.
Zero click ups the chance for UDRPs. Without express written consent from domain owners I think they should not be opting anyone in because of the liability issues.
It should be opt-in not opt-out. That’s just wrong of Sedo to do, but it makes them more money, and us as well, bu at our legal liability.
Overall, this is mostly only good for Sedo, IMO.

We love domains on BN because they sell much faster. So clearly a win-win here.
Also, only BN domains show on our partner sites via SedoMLS Premium.

As a side note on Sedo’s features, I have always disliked the 10k price limit. If “Buy it” now allows lower offers, why not allow sellers the opportunity to set their own price above 10k. The buyer can always come in lower than the seller’s stated price.

I hope that the new feature for BIN prices get implemented asap. It’s the best thing that can happen to sellers for a long time and I am amazed at how so few domainers fully understand the positive implication of this!
I think once the Beta version gets going, Sedo should give the chance to those who favour this new rule first.
