Company claims OnStartups is infringing its marks with its use of trademark.ai.
Trademarkia has amended its lawsuit against Atom to include entrepreneur Dharmesh Shah’s OnStartups LLC as a defendant.
The company sued Atom earlier this month, alleging that Atom’s new trademark search and monitoring tool at trademark.io is infringing its trademark for Trademarkia. When you look at the second and top level domain, it’s off by just one letter. It’s a “spanning the dot” argument; using the second-level domain trademark with another extension probably wouldn’t have led to Trademarkia’s lawsuit.
In the original lawsuit, Trademarkia also alleged that Atom acquired the domain name trademark.ai. It actually appears to be owned by HubSpot co-founder Dharmesh Shah’s business, OnStartups. It forwards to a page with an AI agent, noting that the data is provided by trademark.io. Shah purchased the domain through Atom’s marketplace.
The amended lawsuit (pdf) names OnStartups and states that Trademarkia has offered services at trademarkia.ai with a similar color scheme and design to trademark.ai.
