Estate claims former technology contractor is cybersquatting and infringing its marks.
Rush H. Limbaugh III Estate has sued (pdf) The Rush Legacy, Inc., Smschaef, LLC, and the latter’s principal Scott Schaefer. The estate alleges that the defendants are infringing its marks, cybersquatting, and have misappropriated some domain names affiliated with Limbaugh.
The defendants run a site at EIBLegacy.com which offers paid content and Rush-related NFTs. (Limbaugh’s production company was called Excellence In Broadcasting Radio Network, or EIB.)
Schaefer was previously a technology contractor to Limbaugh. In that role, he registered EIBnet.com and EIBnet.us, which were used for email services for Limbaugh. The estate claims that Schaefer has incorrectly taken control of these domains. In a UDRP proceeding, Schaefer argued that these domains were never Limbaugh’s. That UDRP was terminated because of the legal proceedings.
The lawsuit also claims that the defendants are cybersquatting with their registrations of EIBLegacy.com, EIBnet.com, and EIBnet.us.
The estate is also suing for unauthorized use of Limbaugh’s name and likeness, trademark infringement, and false designation of origin.

Is anyone surprised? The former contractor for the man who built a fortune from half-truths, lies, and deceits is trying to illicitly profit from his mentor’s estate? The pineapple doesn’t fall far from the tree.
