Company filed feeble cybersquatting complaint.
The operator of the controversial Dakota Access Pipeline, which transfers oil from the Bakken formation in North Dakota to Illinois and Texas, has lost a cybersquatting dispute it filed against the domain name dakotaaccesspipeline.com.
Dakota Access LLC (c/o Energy Transfer LP) filed the dispute against the domain name owned by a Virginia man.
The registrant says he registered the domain to provide information about the pipeline. It currently resolves to a registrar holding page.
Dakota Access alleged that the domain owner tried to extort it for access to the domain but the registrant denies this.
The dispute under the Uniform Domain Name Dispute Resolution Policy (UDRP) fell flat on its face, with Dakota Access failing to prove any of the three elements necessary to win such a case.
Panelist Eugene Low didn’t consider reverse domain name hijacking, even though the domain registrant claimed the dispute was filed to harass him.
