Big Chinese internet company forced to defend its Joox.com domain name.
Tencent, the $250 billion company behind QQ, has successfully defended the domain name it uses for its music service Joox.
A Brazilian company that uses the domain name Joox.io for its custom products business filed the complaint.
It turns out that the Brazilian company tried to buy Joox.com from its previous owner. When Tencent settled on the name Joox for its music service, it ended up buying the domain from the that same previous owner.
The panel determined that neither the previous owner (who registered the domain in 2001) nor Tencent registered the domain in bad faith. Clearly, Tencent has also established a legitimate interest in the domain name by developing a music service at the domain.
The three-person panel wrote:
In essence this is a case where two companies, in different parts of the world and operating in different business areas have independently decided to use the name Joox for their business and each has done so at approximately the same time.
Reverse domain name hijacking was not considered.
