.Eco applicant prevails with its own definition of the eco community; .gay and .music applicants don’t.
Three more Community Priority Evaluation decisions for new top level domain names have been completed.
.Eco applicant Big Room Inc has succeeded in getting community status by earning the minimum required 14 of 16 points. This means that applicants Donuts, Minds + Machines and Planet Dot Eco are no longer in the running for the domain name.
dotgay llc failed with just 10 of 16 points and .Music LLC received just 3 of 16 points on its evaluation. .Music LLC’s three points are the lowest received by any CPE panel thus far.
Big Room’s success will come as a shock to many. .Eco has been hotly contested through gamesmanship for many years.
Big Room succeeded by doing something that few contemplated when the new top level domain name guidebook was put together: take a broad concept and then narrowly define a community within it. This worked in community priority applications as well, with domains like .sport prevailing.
The CPE wrote that it “determined that the community as defined in the application satisfies both of the conditions to fulfill the requirements for Delineation.”
To create a delineated community, Big Room defined it as anyone that has a community-recognized members, accreditation, registration, or certification related to being green. That eliminates basically everyone else in the world who is eco-friendly by recycling.

The fact that ICANN did not find gay to be a community proves out the incompetence of their process. The report and justifications for the points awarded were not based on fact. They also used arbitrary loose rules. For example a single and questionable organization filed a protest. The funding of the organization appears to have come from a competitor. In the end the dotGay community applicants prevailed. One would believe that as a result of prevailing, there would be no issue, however the community applicant lost points simply because the protest was filed not because it was legitimate. That puts every community applicant in jeopardy.

On May 7, 2019 after wasting another 2 more years of the U.S. government’s precious time and resources, Big Room Inc’s December 15, 2016 “.eco” trademark case against planet .ECO® LLC was rejected. After Big Room Inc’s final dismissal – planet .ECO® was issued 2 new .ECO trademarks from the United States Patent and Trademark Office (USPTO) in addition to its incontestable trademark covering .ECO Internet Domain Name Services, registered since 2009.
On July 23, 2019 the USPTO issued .ECO Registration No. 5813887 – for “Computerized database management,” in Class 35
On September 3, 2019 the USPTO also issued .ECO Registration No. 5851826 – for “advertising and marketing services…” in Class 35.
On September 4, 2019 the USPTO also rejected Big Room Inc’s application to perform .ECO Registry Operator Services – http://tsdr.uspto.gov/documentviewer?caseId=sn87327563&docId=OOA20190904152931#docIndex=0&page=1.
According to a Department of Commerce representative, the agency did not award Big Room Inc. rights to operate the .eco Registry.
Since 2010 planet .ECO® has prevailed in all 6 Federal Trademark proceedings brought forth by Big Room and TLDH.
