Panelist says .DTV can coexist with .TV.
Verisign has lost a String Confusion Objection against Dish DBS over the string .DTV.
Verisign runs the registry for .TV, and argued that having .TV and .DTV as top level domain names would confuse the average internet user.
Panelist Archibald Findlay turned in a rather lengthy (pdf) 23 page decision detailing both parties’ arguments, ultimately siding with Dish. (Link to decision removed because no longer on ADR website.)
Findlay has decided one other string confusion case, which also happened to be filed by Verisign. In that case, he found that .bom would not cause overwhelming confusion with .com.
Dish plans to use .DTV as a closed top level domain name.
The satellite TV company is still waiting for a decision in a case filed by Afilias, operator of .mobi, against its application for .mobile.
Previously, Dish lost a Legal Rights Objection against its application for .direct, which was filed by rival DirecTV. Dish has asked ICANN to reconsider the independent panel’s decision in the case.
