Health care company files a bad case against someone named McLaren.
McLaren Health Care Corporation has won a UDRP for McLaren.net while losing one for McLaren.biz.
In the case of McLaren.net, the owner of the domain didn’t submit a formal response to the UDRP. He claimed his last name was McLaren, but without providing proof nor a formal response, the panel found against him. The respondent noted that he received the complaint over Christmas and did not have time to make a formal reply.
In McLaren.biz, the respondent did respond and noted that his last name is McLaren.
Of course, McLaren Health Care’s lawyer knew this as it was clear in the whois record.
The panel found against the health care company in this case and noted that simply contacting the domain owner could have cleared up any issues.
Although this was the right decision, the panel could have gone a step further and found reverse domain name hijacking given how it was obvious the registrant had rights or legitimate interests in the domain.
McLaren filed another case that’s still pending against mclarens.com. Given that the domain is owned by McLarens Young International, I’m scratching my head as to what the health care company’s claims on it will be.

They just withdrew the case for mclarens.com. Smart move.
