NameMedia wins charge against marketing firm.
NameMedia, parent company of BuyDomains, has successfully won a reverse domain name hijacking charge against online marketing firm SpinSix.
SpinSix filed for domain arbitration for the domain Lincs.com. SpinSix offers a product called LINCS. According to the complaint, NameMedia alleged that SpinSix manufactured evidence that the parked domain at lincs.com included links that were competitive to it. Although it’s not clear how this may have been done in this case, often times a complainant will use the search box on a parked page to find competitive pay-per-click links.
But that wasn’t even an important issue in the case, since NameMedia’s registration of the domain pre-dated SpinSix’s first use of the term lincs. SpinSix was awarded a trademark for lincs in 2009, but claimed first use back in 2004. Even if the panel granted SpinSix rights back to 2004, it was still after the domain was registered in 2003.
