Finally, someone with common sense lays the hammer on Kentucky’s Governor.
A Kentucky appeals court has granted a motion to stay the forfeiture hearing for 141 gambling related domain names until it can hear arguments. Of course the appeals court could still make a blunder, but this is further proof that U.S. courts eventually get most things right and prevent injustice. Although painful and expensive for domain owners, the fact that U.S. courts have a good appeals system is just one of the reasons I don’t recommend fleeing U.S. registrars.
Governor Steve Beshear certainly has mud on his face and underestimated the forces he’s dealing with. Last week three groups that have much more sway than domainers — The American Civil Liberties Union (ACLU) of Kentucky, the Electronic Frontier Foundation (EFF), and the Center for Democracy and Technology (CDT) — filed a “friend of the court” brief about the case.
And it was fairly clear from the beginning that Kentucky’s Attorney General wanted nothing to do with the case, repeatedly pointing out to the press that his office wasn’t bringing this action.
This fight isn’t over, but after nothing but bad news there is finally something to smile about.

As I have stated previously If I owned any of these domains I would be taking legal action againest Kentucky when the case finnishes and get back lost revenue!
