Valero is third company to belatedly request .xxx domain name

Energy company complains to WIPO about Valero.xxx.

San Antonio, TX based energy giant Valero Energy is the third company to ask an arbitration panel to give it a .xxx domain name.

The company filed a complaint last week with World Intellectual Property Forum (WIPO), seeking control of Valero.xxx.

The domain name was registered by someone in the Netherlands on December 6, the first day .xxx domain names became available for general registration.

This is the second .xxx dispute filed with WIPO. VIPINDIRIM filed a complaint for markafoni.xxx last month in what I believe to be the first ever filing over a .xxx domain name.

Also, an unknown company (but possibly San Antonio based grocery chain HEB) filed a complaint over HEB.xxx at National Arbitration Forum.

What may make .xxx UDRP cases interesting is that many of the domains don’t resolve. That may not be an issue with a domain similar to Valero.xxx, but it will make it hard for companies to win domains that could have multiple meanings because they won’t resolve to parked pages.

    The fact that the domains do not resolve to parking pages is not a catchall defense. Non use may be interpreted negativy. Guess it will come down to the rationale provided for registering the name in such instances. I cant imagine Nike would lose a claim on. NIke.xxx because there was no parking lander

    @ Y. Poe – absolutely. But if heb.xxx was filed by the grocery store chain, it would be a lot easier for them if it resolved to a parked page with grocery ads.
