SnapNames and Oversee.net Sue Nelson Brady aka Halvarez

Lawsuit filed against former employee over bidding scandal.

SnapNames and its parent company Oversee.net have sued Nelson Brady, the former employee allegedly at the center of a massive bidding scandal last year. The company is seeking $33 million in damages.

In a media statement, the company said:

“Oversee will be demanding millions of dollars from Brady for the damage he caused to Oversee and SnapNames. No amount of money, however, could compensate the damage Brady has caused to SnapNames’ and Oversee’s reputation in the marketplace.”

Last year the company also voluntarily disclosed Brady’s conduct to both the US Attorney’s Office and to the Federal Trade Commission. Oversee will not publicly discuss anything relating to law enforcement matters.

According to the company, it has been trying to settle the matter with Brady out of court, but that those settlement efforts were unsuccessful.

    WE are all responsible for our actions but Snapnames and Oversee must accept some responsibility. If a bar serves too much beer, they can be liable if someone is drunk and drives.

    If your employees are manipulating the sytem, they are certainly resposnible, but you as the employer must be accountable for not seeing it, stopping it and correcting it.

    Amazing how industries, politics and companies pin the tail on the donkey and blame others, but never take the burden of accountabilty themselves

    Um, I didn’t know you could see your own employee. You are responsible for your employee.

    He can be held criminally, but I don’t know if they can sue him.

    And how has Oversee not done that? They paid out for every customer whose bid was bumped up, they modified the settlement agreement in response to customer feedback, they reported Brady to two law enforcement authorities, and now they are trying to get back what he cost them.

    Oversee has been accountable for what happened. Nelson Brady was not just any employee, either. As VP of engineering, he was uniquely positioned to cover his tracks. However, he was caught, turned over to law enforcement, the customers compensated, and he’s going to pay.

    What, specifically, is it that you think Oversee should do here, which it has not done and is not doing?

    Of course they can. Employers and employees sue one another all of the time. It’s a pretty safe bet that Nelson Brady was acting outside of the terms of his employment contract.

    So, the takeaway here is that if you’ve been embezzling from the cash register at work, you had better be prepared to pay that back.

    My questions to the statement are:

    How long did it take before they saw the abuse? Many customer complaints, yet no investigation. This was not a weekend affair but years of manipulation.

    Grant you – he must of covered his tracks well and yes – rebates are in full swing.

    My appologies. I was unfair to SnapNames and Oversee.

    My recommendation would be let the law do its thing. Then when convicted, sue if need be.

    Personally, everytime they bring this event up, such as announcing this suit, they expose the sore again. Let it heal. let the law do their thing and move forward.

    They will win more money back by focusing on customer service and building relationships instead of trying to recoup the lost money due to Nelson.

    @ Mikey – people have been blasting oversee for not suing Brady, saying there must be more to the case than what meets the eye. By filing the suit, they are showing they are clean. A lot will come out because of this, but they must be confident Brady was the only one at fault.

    As for the many customer complaints, I think Oversee has explained this already. Every time someone complained, they asked Nelson Brady to investigate.

    Put your thinking cap on for a moment. You run a tech company. You are getting complaints and want to investigate them. Who do you have investigate it? The marketing people or the VP of engineering?

    You see how that works.

    Oversee announced it because of the contingent that still subscribes to some kind of conspiracy theory that Oversee wouldn’t sue Nelson because they were in on it.

    Some people don’t like the mixing of real events with twists of reality for the purpose of entertainment. That’s why DomainGang – or TheOnion – are not suitable for everyone.

    Facinating, first Oversee ducks a class action law suit because the class action threshold had to have been 15 million and this the suit was tossed by the court?

    @ stewart – the $33m include punitive damages. I believe the $5m number had to be actual losses incurred by the class.

    I think I understand now. That is why they need to look at the contract Nelson signed.

    Nelson better be putting his money in a trust fund or some place they can’t touch it.

    He had to know he would get caught. Especially when he was voted #1 sniper by everyone.

    Most companies have a policy of furloughing sick employees, so they can get needed R&R. Brady engaged in sick behavior, IMO . . . was it necessary to sue?

    Mickey–they can’t wait for that, as there’s a (often “just” 1-2 yrs) relatively short (compared to criminal) statute of limitations on civil actions.

    I used snapnames for years.

    The question: Did Halvarez ever win an auction? I have asked this, and they didn’t give me a straight answer. Many times, somebody else bid higher, and I stopped.

    If Halvarez actually won an auction, then whatever Nelson sold it for, revenue he made, or more, is the damage done to the bidder below him.

    So, did he ever win an auction?
    If he did, then the damages are huge in lost value, revenue, and opportunity.

    Anybody know if he ever won?

    I doubt you will get a judge to agree with that theory of speculative damages. If you did not win the name, you did not lose anything, and are not entitled to compensation to make you whole.

    I was driving to a job interview and someone hit my car at an intersection. Consequently, I was late to the job interview and someone else got the job. Now, if I had gotten the job, I would have worked there for several years, been promoted, and eventually become president of the company. So, does the person who hit my car owe me years of “lost” salary and an executive compensation and retirement package?

    No, they owe me for the fender of my car. You don’t recover for a chain of “coulda, woulda, shoulda” type situations.

    Aside from which, I’d love to see someone claiming “damages” from failure to purchase names like “victoriassicret.com”. This is like arguing that some other criminal robbed the bank you were planning to rob before you got there.

    Including snapnames and moniker lol. The analogy applies. Brady made off with the profits moniker and snapnames would have made from the sale of these obviously infringing domain names themselves thereby effectively it was Brady who was robbing the bank before Moniker had a chance to rob it themselves. Dont just blame the bidders John. To use one of your analogies its not just drug users that go down when the crack house is busted, the dealers go down too. Fortunately for them they can employ good lawyers to tilt the arguments in their favor.

    I can see it now….

    DomainSponsor is a company with out ethics. Big suprise they had an employee that was without ethics. Slime, meet slime, a marraige made in heaven.
